New York Apartment Building Accidents

$2.7 million dollars. Blanca Colon, 37, was admitted into Woodhull Hospital complaining of respiratory distress. She was not properly diagnosed and treated, which led to her untimely death. This medical negligence case was settled for $2,750,000. Blanca left behind her husband, one adult daughter and two minor children.
$750,00 Assault Case A young Bronx man and his wife successfully sued the City of New York, because the City failed to provide working locks on the door of his building. As a result, the man was mugged and shot by a criminal who gained entry to the building.
A 30-year-old woman who lost a small portion of her finger when a defective door closed on her hand received a $125,000 settlement from the building owner.
$175,000. A woman was assaulted in the lobby of her building due to the lack of security and a failure to maintain locks. The perpetrators were never identified.

New York Auto Accidents

$14 million dollars Auto Accident Case for a woman in her 30's who was seriously injured in an automobile accident due to faulty roadway construction.
$2.5 Million Dollars. Car Accident Case A man, 42, was at a holiday sponsored by the local restaurant and tavern owner's association. There was an open bar. It was claimed that the bartenders continued to serve drinks to the individual who was going to drive the plaintiff home even after that individual was visibly intoxicated, a violation of the ''Dram Shop''laws. The person driving the plaintiff home did, in fact, crash his car causing the plaintiff to sustain injuries that resulted in paralysis. The driver was convicted of driving while intoxicated. The plaintiff was in a rehabilitation facility paid by Medicaid.
$500,000. A hardware store owner, formerly a NYC police officer, was sideswiped on the FDR Drive, causing his car to overturn and hit the median. He suffered a fractured neck.
A woman who was struck by a telephone company truck as she crossed the street sustained fractures that required surgery. She obtained a $395,000 settlement for her auto accident case.
$375,000. Crossing the street with his mother, a 6 year old boy was struck by an ambulance traveling the wrong direction down a one-way street. His broken leg required surgery. His mother was awarded an additional $70,000 for being in the zone of danger and suffering in an automobile accident.
$350,000. While crossing the street to go to church, a grandmother, 72, was struck by a car making a right turn while the driver was talking on a cell phone. The fractured knee she suffered from the car crash required surgery.
A 60-year-old Mexican immigrant who suffered several fractured ribs and a punctured lung in a car accident was awarded a $225,000 settlement.
$225,000. The family of a 70-year-old retired woman who was living alone was awarded a settlement after she died from the injuries she sustained one month after being struck by a motor vehicle.
$280,000. A Brooklyn delivery man and father of three was involved in an automobile accident while he was working, when another driver attempted to make a right turn from the left lane. His fractured hand surgery and settled his case for $280,000 during trial.

New York Construction Accidents

$4.9 million dollars. A mother of five, 32, who is a union member and a native of Puerto Rico, was injured on a construction site and suffered multiple back and head injuries when she fell from an elevated cement platform that did not have adequate or proper safety rails. Due to her head injury, she lost her sense of smell.
A 20-year-old man whose leg and back were seriously injured when a wall collapsed, knocking him off a scaffold, won a $3.9 million settlement. The young man underwent several surgeries and rehabilitation but was left with a permanent limp and a deformed foot.
$3.45 million dollars. A 33 year old family man and laborer, recently arrived in New York from Puerto Rico, was working on a scaffold that shifted and collapsed to the ground. He fell 20 feet and suffered multiple fractures to his hip and shoulder. A simple safety belt would have prevented his injury.
A 32-year-old construction worker from the Dominican Republic was awarded a $3.3 million settlement after he fell from a scaffold in New York that was missing important safety devices. The man broke numerous bones, causing complications to his sickle-cell anemia and sexual dysfunction.

$2.95 million dollars. A 29 year old undocumented roofer from Guatemala, who worked in this country for many years, suffered multiple fractures to his knee, hip and foot when he fell from a roof, due to violations of the New York State Labor Law. His boss ignored safety compliance at the jobsite.
$2 million dollars. Ramiro Polanco, a 43 year old undocumented worker, came from the Dominican Republic with a dream of someday bringing his family to the United States. Unfortunately, he was involved in a construction accident that resulted in severe injury to his legs.
$2 million dollars Ronny Jimenez, 37, was working on a New York scaffold that collapsed, and he fell 25 feet, causing great injury to his ankle. A native of Costa Rica, Ronny was the sole provider for his two children that lived in Florida.
$879,475 dollars. A 39 year old undocumented construction worker fractured his pelvis and wrists after falling from an unsecured hanging scaffold in New York, more than 20 feet above the ground.
750,000 dollars. An undocumented immigrant who fractured his skull when he fell off a ramp while working at a construction site settled his case.
$750,000. An Ecuadorian immigrant was building a house and fell approximately 20 feet when an unsecured ladder slipped out from under him. There were no safety devices to secure either the worker or the ladder. He suffered a fractured back, heel and knee, requiring two operations.
$495,000. Victor Reyes, 37, an undocumented construction worker from Mexico, fell 25 feet from a scaffold that did not have safety rails. He was not provided with a safety belt or harness. Victor sustained a heel fracture.
$463,000. A construction worker, 33, was not provided with a safe place to work. Standing on 3-foot stilts, he tripped over debris, fell, and fractured his elbow.
400,000 dollars. A 22 year old construction worker fell from the ladder he was working on, badly hurt his hand, and needed surgery.
$400,000. A young immigrant day laborer who fell from the ladder he was working on at a construction site sustained severe lacerations to his hand, requiring surgery.
$750,000. An undocumented, immigrant worker fractured his skull when he fell off a ramp while working at a construction site. The settlement included his lost wages and pain and suffering.
$900,000. Luis Martinez, 46, an undocumented laborer from Columbia, fell 15 feet through an unprotected and uncovered hole in the floor on a construction site where he was working. At the time of the accident, he was married and supporting his children by sending funds to his home country.

New York School Assault

A Bronx jury ordered New York City and the Board of Education to pay $2.54 million to a 19-year-old woman who had been attacked at school several years earlier. Another student had slashed her with a knife during a fight, leaving her with a permanent scar across her left cheek.

New YorkSubway Accidents / Trip and Fall

$18 million: A 20 year old man who was inebratied fell onto the subway tracks, and was there for some time before the train entered the station. During trial it was evidenced that the motorman had sufficient time to stop the train to avoid the accident, but did not, causing the young man to be be run over, and rendered quadriplegic because the operator of the train failed to comply with New York Metropolitan Transit Authority (MTA) rules.
$450,000: A Brooklyn man fell walking downstairs to the subway, when he stumbled on a broken step. His fractured elbow required surgery.
$450,000. Walking with her son, a single mother, 31, tripped and fell down a subway staircase with a missing handrail. Her ankle needed surgery.
$400,000. A 23 year old butcher successfully sued his friend's landlord in a trip and fall case for not keeping the elevator in good repair. The young man tripped and fell out of the elevator, which had stopped a few inches lower than the lobby floor. He broke his elbow and suffered nerve damage to his arm. He under went two surgical procedures.
$390,000. A 35 year old pregnant woman won a settlement against her sister's landlord in a trip and fall case when she slipped and fell on water due to a chronic leak that the landlord never properly repaired. The young woman was visiting her sister's Bronx apartment when she slipped and fell. Her fractured leg required surgery.
$350,000. A Queens man won a settlement against a landlord when he was returning home after dinner with his son when he tripped and fell out of the elevator which had stopped short of the 4th floor landing. He suffered a broken ankle and needed surgery.
$325,000. A woman successfully sued her landlord for not keeping her the lobby of her apartment building clean. While walking through the lobby, this 40 year old postal worker slipped and fell on a greasy substance that had been on the floor for a couple of days. Her broken leg which required surgery.
$300,000. While vacationing in New York City a tourist, 70, tripped and fell on a raised sidewalk flag, fracturing her hip and elbow.
$275,000. A Bronx father of two successfully sued his landlord for not clearing the snow and ice when he slipped and fell on the ice on his way to work. His fractured wrist required an operation.
$125,000. A Brooklyn man fractured his ankle while exiting the first floor apartment of a three family house. The handrail gave way as he attempted to brace himself from falling after slipping on ice on the stairs.
$195,000. A Queens woman who was unable to support herself after she tripped and fell on a staircase lacking a statutorily mandated handrail. Her fractured arm required surgery.
